                Meeting Called to Order by Chairman Cook at 6:30 p.m.

                APPOINTMENTS & HEARINGS:

                Public Comment:

John’s Pond resident Bill Martiros commented on the problems effecting John’s Pond.  Mr. Martiros indicated the troubles in John’s Pond are far worse than Santuit Pond.  Several concerns included the boat launch ramp located at John’s Pond Estates, the state boat launch ramp at Hoophole Road, and the ramp at Briarwood.  Mr. Martiros also indicated that a containment trench from Otis AFB also drains into the pond.  In addition, Moody Pond runs into John’s Pond, and water from a state trench made with bluestone located on Algonquin Road flows directly into the pond.  Mr. Martiros also stated that since the water levels have not been maintained at the cranberry bogs, the shoreline has been undermined.  As a result, he has lost approximately 4’ of property frontage.  Mr. Martiros informed the Board that over the years, John’s Pond has deteriorated.

Being public comment only, the Town Manager requested Mr. Martiros forward his list of his concerns to the Office of the Selectmen/Town Manager for additional review.  The matter will be referred to the Environmental Oversight Committee.

In other matters, Lynda Carroll of the Mashpee Food Pantry met before the Selectmen to request consideration to use the basement at the Main Fire Station.  Ms. Carroll indicated she expects to move from The Mashpee Village soon, and no one has come forward to offer a site location for the Mashpee Food Pantry.
In concern to their plight, the Town Manager indicated that presently there is no space available.  In response to the request to use the basement of the fire station Mrs. Mason indicated that it is not handicapped accessible for use as a food pantry.  In an attempt to offer an alternative, it was noted there are two food pantries in the Town of Mashpee.  Confidential outreach can also be obtained from the Human Services Director and Human Services Committee.  The Falmouth Service Center also supplies food to many Mashpee residents.

Mrs. Carroll stated that many Mashpee residents seeking assistance from the Mashpee Food Pantry are embarrassed, and there has been concern regarding depression.  Mrs. Carroll explained that many residents do not drive and therefore are unable to get to the Falmouth Service Center.  With the upcoming holiday’s Mrs. Carroll stated that something has to be done.  

Janet Amico was also present on behalf of the Food Pantry.  She indicated that she had intended to make a power-point presentation on the subject.  In the absence of a presentation, Ms. Amico made note of several Massachusetts towns that house their food centers in the basement of fire stations, in senior centers, and inside basements of libraries.  

Peggy Bent also present in concern for the Food Pantry urged the Selectmen to reconsider the use of a Town facility.  If not, she suggested the matter go before Town Meeting to let the voters decide.

As a result of the following Public Hearing advertised for 6:40 p.m.  The discussion was deferred until the conclusion of the hearing.

                APPOINTMENTS AND HEARINGS:

Public Hearing – Request to Place Sign on Town Property – Capewide Enterprises:

In accordance with posting procedures, the Board of Selectmen opened the Public Hearing on the application of Capewide Enterprises, LLC, 153 Commercial Street, Mashpee for permission to place a sign on Town property.  The hearing notice was read aloud into the record.  The applicant was in attendance for discussion purposes.

It was disclosed the site location 153 Commercial Street is the former location referred to as 203 Industrial Drive, Mashpee.  A depiction of the intended sign and its size was presented to the Selectmen for additional review.  It was noted the applicant is scheduled to meet before the Design Review Committee tomorrow morning.

Being no comment, the Board motioned to close the Public Hearing.

Motion made by Selectman Cahalane to close the Public Hearing.
Motion seconded by Selectman Richardson.
VOTE:  Unanimous.  5-0.

Motion made by Selectman Cahalane to approve the application of Capewide Enterprises, LLC, to place a sign on Town property under the provisions of the Town bylaw §174-56, as specified, permits for such signs may be revoked at any time by the Board of Selectmen, and with the stipulation, the sign is approved by the Design Review Committee.
Motion seconded by Selectman Taylor.

APPOINTMENTS AND HEARINGS:

Public Comment:  There was no one present to continue discussing the matter of the food pantry.  As a result, there was no further discussion on the subject.

New Town Website Presentation:

Tom Mayo, Mashpee’s GIS Administrator led a power-point presentation on the new website for the Town of Mashpee.  Mr. Mayo indicated the new website www.mashpeema.gov should be online as of Thursday.

It was explained the project which began last June has had input from the IT Director, the Town Manager and Board of Selectmen.  Several attributes to the new site include a banner of photographs to highlight Mashpee, and a new link: Ask the Selectmen.  The drop-down bar will list the individual Selectmen members to contact and all emails shall be copied to the main office.

Each Department is now responsible for their own webpage.  Departments, boards and committees will be requested to designate an individual to update their respective webpage information.  It was suggested that a separate Town employee be designated to oversee the web pages of the departments to ensure they are updated on a regular basis.  Mr. Mayo indicated that he would be responsible to follow through with current information on the main web page of the Town’s website.

Another new initiative on the main page that will change continuously is the current events, an announcement of completed projects and achievements.  Presently, the new Mashpee Library, the notice the Town of Mashpee has been designated as a Green Community and the installation of the new Micro-Wind Spires are illustrated.  It was suggested the Single Stream Recycling Campaign be added as a new initiative.  A calendar of information is now readily accessible on the front page as is the weather and local tides chart.  It was noted the School Department is also included on the Town’s new website.

The Selectmen were pleased with the new initiative for the Town of Mashpee and its citizens.

OLD BUSINESS:

School Grant Discussion:

Maria Hortaridis, School Business Manager and Ann Bradshaw, Superintendent of Schools were in attendance to request the Selectmen
authorize the Superintendent to submit to the Massachusetts School Building Authority (MSBA), the Statement of Interest for the Green Repair Program dated September 16, 2010 for the Green Repair Grant to replace the aging HVAC unit located in the Quashnet School Cafeteria 150 Old Barnstable Road, Mashpee.  The replacement is a priority for the Mashpee Public Schools.

Ms. Hortaridis explained the HVAC unit is presently 32 years old and in dire need of replacement.  At this time, the HVAC unit is not functioning, and there is no fresh air exchange or warmth for the students.  In the winter, when in the cafeteria, the students wear their coats to stay warm.

The Town Manager indicated the Quashnet School replacement project has been in the Capital Improvement Program (CIP) for several years and recommended approval.  It was disclosed the Commonwealth of Massachusetts has recently certified the Town of Mashpee as a Green Community.  As a result of the Green Community designation, Mashpee is expected to receive state funds for energy efficient initiatives.  However, the replacement of the aging HVAC at the Quashnet School is not part of the intended grant program.

With regards to the Green Repair Grant, the following was read aloud into the record by Selectman Cahalane:

MASSACHUSETTS SCHOOL BUILDING AUTHORITY

FORM OF VOTE – Board of Selectmen’s Meeting, October 4, 2010

In accordance with its charter, by-laws, and ordinances, The Mashpee Board of Selectmen is authorizing the Superintendent to submit to the Massachusetts School Building Authority the Statement of Interest for the Green Repair Program dated September 16, 2010 for the Mashpee Public Schools located at the Quashnet School at 150 Old Barnstable Road in Mashpee,  which describes the following deficiencies and the priority category for which Mashpee Public Schools has been invited to apply to the Massachusetts School Building Authority.

Description – HVAC Unit in the Quashnet Cafeteria is not functioning.  The age of the boiler and the HVAC system is 32 years old.  Needs replacing.

I hereby further specifically acknowledge that by submitting this Statement of Interest, the Massachusetts School Building Authority in no way guarantees the acceptance or the approval of an application, the awarding of a grant or any other funding commitment from the Massachusetts School Building Authority, or commits the Mashpee Public Schools to filing an application for funding with the Massachusetts School Building Authority.

Motion – Motion made by Selectmen Cahalane to authorize the Superintendent to submit this Statement of Interest for the Green Repair Program to the Massachusetts School Building Authority.

NEW BUSINESS:

Request to Enhance Police Patrols – Sea Oaks Condominium:

Correspondence was received from the American Properties Team, Inc. dated August 28, 2010 on behalf of the Sea Oaks Condominium, 195 Falmouth Road, Mashpee requesting the Selectmen authorize the Chief of Police to direct enhanced patrols and enforcement of posted speed limits within the condominium complex.

It was disclosed the Board of Selectmen have not accepted the streets within the Sea Oaks Condominium complex for enforcement as they are deemed private ways.

Rodney Collins, Chief of Police was in attendance to review this matter with the Board of Selectmen.  In accordance with MA General Law Chapter 90, Section 18, the Board of Selectmen has the authority to empower the Police Department to enforce speed regulations.  This is an enforcement mechanism to enforce speed regulations, and there is no favoritism to increase patrols at the subject site location.

It was disclosed that an opinion was obtained from Town Counsel without objection with respect to this regard.  Chief Collins recommended the Selectmen’s approval on the basis of inspection of the area and notice from the Sea Oaks Board of Trustees.

Motion made by Selectman Cahalane to accept the request of Sea Oaks Condominium, and empower the Mashpee Police Department to enforce speed regulations posted on the property, 195 Falmouth Road, Mashpee.
Motion seconded by Selectmen Richardson.

Acceptance of Resignation – Planning & Construction Committee:

A letter of resignation from the Planning & Construction Committee was received from Sheldon Gilbert dated September 23, 2010.  Mr. Gilbert served as Chair of the Library Building Committee until it was abolished and its responsibilities were transferred to the Planning & Construction Committee.

Motion made by Selectman Cahalane to accept the resignation of Sheldon Gilbert from the Planning & Construction Committee.
Motion seconded by Selectman Taylor.

LIAISON REPORTS:

SCBAC:

The South Cape Beach Advisory Committee has requested a letter of appreciation be remitted to Ben Lofchie for his dedicated service.  It was noted that all persons resigning from respective Town boards and committees receive letters of appreciation for their service to the Town of Mashpee.

Sign Bylaw Review Subcommittee:

The Sign Bylaw Review Subcommittee is scheduled to meet this Friday to hear public input on the proposed new sign bylaw.

School Committee – Selectmen Liaison Assignments:

It was reaffirmed a Board of Selectmen member has the role to serve as liaison for their respective boards and committees which allows Selectmen members to serve as a conduit to disseminate information.  Decisions are made as a full Board of Selectmen.

Motion made by Selectman Cahalane to adjourn at 7:20 p.m.
The Board will enter into Executive Session for the purpose of discussing contract negotiations.
The Board will not reconvene in Open Session.
